U.S. Transhumanist Party Applauds Supreme Court Decision Upholding Birthright Citizenship in Trump v. Barbara
July 1, 2026 – The United States Transhumanist Party (USTP) today expresses strong support for the U.S. Supreme Court’s June 30, 2026, decision in Trump v. Barbara, which upheld the constitutional guarantee of birthright citizenship for children born in the United States to parents who are unlawfully or temporarily present.
In the majority opinion authored by Chief Justice John G. Roberts, Jr., the Court held that such children “are ‘subject to the jurisdiction’ of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause.” The opinion affirms the plain text of the Clause—“All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside”—and its historical grounding in common-law jus soli (right of soil) principles, the Civil Rights Act of 1866, and precedents such as United States v. Wong Kim Ark (1898). The Court explicitly rejected attempts to add limitations based on parental immigration status, temporary presence, or domicile, concluding that “Children born in the United States to parents unlawfully or temporarily present are subject to the Nation’s jurisdiction.”
This ruling aligns directly with key provisions of the U.S. Transhumanist Party Platform. Section II of the Platform condemns “any hostile discrimination or legal restrictions on the basis of national origin, skin color, birthplace, ancestry […] or any manner of circumstantial attribute tied to a person’s lineage or accident of birth” and “strongly opposes any efforts to enforce said restrictions regardless of cause or motivation thereof.” The Supreme Court’s rejection of the Trump Administration Executive Order’s attempt to carve out exceptions to birthright citizenship based on parental status upholds this principle of equality and rejects arbitrary barriers tied to circumstances of birth or national origin.
The decision is further consistent with the USTP Platform’s pro-immigration commitments. Section XCIII supports “efforts to provide a path to legalization for all current undocumented immigrants living and working in the United States, free of restrictions based on country of origin…” Section XCV calls for modernizing and streamlining the immigration process. By safeguarding the foundational right of citizenship for those born on U.S. soil, the Court reinforces the inclusive framework the USTP has long advocated.
